Hi all,
Any one can please help me, I am leaving at Atlanta, Georgia, I have 5 years old son his passport is going expire next month so I would like to apply. Any could tell me what are the documents required, what form I need to fill, fee, where can I apply for renewal etc......

Hi,
My GC is still a far away thing for me. But I want to know this to prepare potential interview questions.
After getting a Green Card, as far as I know, if you live outside of U.S. longer than 6 months, you lose your Green Card.
Does that also apply if you are dispatched by your company (supposedly big U.S. corporation) to a overseas office for a couple years?

I was in a similar situation, and they got my PP H1 because of my overseas travel.
If you get a H1 extension before you travel, you can show the new H1 (I-797) at the POE and the inspector will stamp Mar 08 on your new I-94.
If your H1 is not approved by the time of your return, you can have Mar 07 on your I-94, and your extension approved thereafter is valid. The I-797 will have a I-94 that'll be valid till Mar 08.
The gray area, it seems, is if your H1 is approved when you are outside the country. In that situation, apparently, you need to get a visa stamp before you re-enter US. If you think that you could be in this situation, check with an attorney. I think they call this the "Last Action Rule".
I have my H1-stamping and I-94 valid until March 07, My H1 extension was applied during Nov - 06, but not approved yet....In the mean while, can I visit India and return by Feb 07 ? On my return, I will still get my I-94 till March 07, but Once my H1 extension is approved it will have the I-94 attached to it till Mar 08, is this I-94 valid ?
My employer is saying that, the new I-94 that I got from my H1-extension is not valid and they have to file a new H1 OR I have to convert the H1 extension to Premium and travel with the approved H1 extension ?

It is not just enough for you to have the qualifications for EB2. The job requirements also should have that requirements. So in the PERM application - the job requirements has to be specified. I think the lawyer messed up the PERM process

I have one question about signing the affidavit of support (864) for immigration of a family member.
(i.e. For petition for Immediate Relative- daughter files for mother)
If daughter signs an affidavit of support for mother (i.e. form 864) for immigrant visa (Immediate relative) then in that case for daughter is it going to create any problem in getting study loans/home loan in future?

My friend has a GC since Sep 2004. He recently went to India and married a person who has a stamped F-1 Visa though she has not entered the USA yet. They are planning to enter US this month. Is this legal? What should they be worried about and what are my friend's options if he wants to settle down with his wife in the USA. Will there be an complications if he applies for her GC or should he rather wait till he gets his Citizenship. Any comments would be appreciated

Hi Folks,
I am currently on EAD and am applying for extension using e-file. I had a question on what do we fill in for 'Current Immigration Status'. The closest I can think about (as per the options given) is : DA - Advance Parole (Dist Auth).
Any comments?
Has anyone using EAD currently done an e-file for extension?

My first camera was a refurb d80 and there was no way to tell the diff between new or used. I bought a new d300 and love the camera but out of the box it seemed to be in the same great condition as the refurb d80.

Don't panic. It will be alright you can resubmit the correct fee you have 30 days to do that. Sometimes USCIS can make mistakes even you submitted correct fee.

I have been trying to go thru various threads in this sub-forum. I have few questions, which I will appreciate if anyone can answer:
1. Are you responsible for invoking the AC21 or the new company that hires you does that?
2. Will you be hired into new company using EAD or H1B?
3. Does H1B need to be transferred to the new company anyways?
4. If wife has started using her EAD, how does that get affected?
5. Can you continue to use the AP issued or do you have to have a new AP re-issued?

I have been waiting for EAD for the last 120 days. I had an info pass inquiry last month. I was told that my I- 765 and AP applications are on hold because of back ground check. Please advice can I get interim EAD from Detroit office while my application is on hold. I have info pass inquiry for next week for Interim EAD, will Detroit USCIS office help me out OR just another endless waiting time. I don�t know what to do, I have been out of work for last 4 months because of work permit. Can anybody advice me, what should I do. I have applied for I-485. Thanks

this is an attorney question. also this forum is for employment based green card issues. please check with ur attorney.
Can you please help me figure out how to calculate the eligibility for citizenship. If one married a US citizen. Obtained conditional residency, the temporary green card, then forgot to apply to remove conditions. So re-applied for green card, and was granted. The parties have been married 5 years. Will the initial 2 years spent as a conditional resident count towards the 3 years for the citizenship? Again, I want to stress out that after the initial 2 years in conditional permanent residency, forgot to remove conditions, and a new application for green card was needed. However this time the permanent green card was given. Or will she have to wait another 3 years from now on with the permanent green card until applying for the citizenship?
I appreciate any help.
