Yes, I would attempt Premium Processing on the pending I-140 first so that I can invoke AC21. I never heard of anyone's GC process jeopardized due to H-1B denial.

The attorney sent my I-94 and we got approval until Nov 2010. (this happened in sep/oct 2008)

Guys,
I am happy to share with you all that I applied my 485 on 1 week of June and it got approved today.
My PD was dec 2005. eb3. India.
Thought i would share with you all.:)
How is that even possible. How were you able to file with a Dec 2005 EB3 India PD in June 2007 when they were only accepting applications with PD of June 2003 for Eb3 India?????

Some countries require transit visa like UK for even changing flight but going through Germany do not require such a visa for EAD holders, you should contact the local consulate for B-1 holders.
Hope you have filed a Police report and got the pp based on it. Very sorry for your loss, wish you recover the stolen items before leaving for India.

One more query..If H4 visa has expired but I have H4 extension till 2009, can I get H4 stamp in India.
My case traveling in Jan to india, My H4 was expired but I have extension. Can I get it stamped as H4. I will be appying for EAD in Nov 07.

Applying for EAD does not invalidate your H4 status. If you travel outside USA without AP and you don't have a valid H4 stamp on your passport, It is considered abandoning your AOS. Hope this helps.

In this case you can not port the PD unless your subsequent I140 is approved ( ie your Feb-08 I-140 is approved) Once this get approved, you can port to already approved EB2-I140 to make your EB2-140 PD same as your EB3-I140 PD.

Since the MTR was already filed you can still extend the H-1B. However, if the MTR gets denied then no further H-1B visa extension is possible.
BTW - even the H-1B extension can be applied based on 'Labor Certification applied more than a year ago' criteria an I-140 denial will override the above benefit.

NO the officer did not do the right thing. The officer should have put the expiry date of your 797 instead of your visa stamp as the right expiry date is the 797 date in your case. You should try to contact the concerned airport's CBP office and ask them to change it. Since this I-94 was issued later after the I-797 there is a chance that USCIS might hold a position that the your new I-94 is your correct I-94. So you should try to get your I-94 corrected as soon as possible.

When the poor Irish came to US, was there a rule that said, they can get their papers sooner if they pay some extra money? Premium processing is creating elitism by encouraging the well-heeled to pay to be above a system. Was there a rule that said that Vito Corleone would have to stay on Ellis Island and not work for several months if he didnt pay extra money to get his I-130 processed? But, today..the system is doing exactly that. They are confining our personal Godfathers (who we are mortally scared of .i.e or wives) to stay at the virtual Ellis Island (read as - 1 Bedroom apartment) and not allowing them to work till we premium process the shirts off our back.

As much as I want the W2 ASAP, the issue is what is the amount that should be on the W2 as I did not get paid in 2007. The W2 legally should only contain the wages that you have received in that year.

What I dont understnad is that if they skipped security clearances on AOS applications to use up numbers..how does it imply taht they would have to eat crow and accept July application...Logic doesnt explain this,
They have alrady made teh blunder of skipping sec clearances...What they can now request is to go back and correct that mistake and ask that any and all applications in July be rejected so that they can do sec clearance on the ones they already used up/approved..

I think the statement from Greg Siskind is that 'if they dont want to answer these questions about security clearance etc, the simplest way out is to accept the July Applications and get everyone off their back (irrespective of whether visa numbers are there or not).

They cant say they are scared of an inquiry or a lawsuit. Settling the AILF lawsuit is probably that way out. The amendment is denied because of the Annual salary specified & also because we couldn't get the End client letter(Client told me that it's company police not to provide such type of letter). we provided main vendor contract.
